Boat builder pleads no contest in 3 deaths

PARKER - A California boat builder charged with three counts of negligent homicide changed his plea from not guilty to no contest.
Grier Dean Rush, 63, of Maywood, Calif., entered his plea Tuesday in La Paz County Superior Court. He also pleaded no contest to one count of aggravated assault with a dangerous instrument causing substantial injury.
The defendant now faces up to 15 years in prison, said La Paz County Attorney Glenn Buckelew. He said that Superior Court Judge Michael Burke could impose anywhere from 1 to 3.75 years for each count.
The charges were leveled against Rush, the owner of Rush Performance Boats, following a Sept. 19, 2003, accident on the Colorado River north of Parker in which three young people were killed and a fourth was seriously injured.
La Paz County Sheriff's reports said that a Sanger jet boat, driven by Jonathan Herbert, Laguna Hills, Calif., with passengers Raquel Herbert, 18, the driver's sister, Ashley Rollins, 18, and Josh Rogers, 18, collided with a Rush Performance Boat driven by Rush. Two passengers, Don Kramer, of Norco, Calif., and Steve Shoop, Minnesota, were riding with Rush.
The young women and Josh Rogers were recovered from the water and taken to La Paz Regional Hospital in Parker. The young women were pronounced dead and Rogers was airlifted to a Phoenix hospital with serious injuries.
Buckskin Fire Department divers recovered Jonathan Herbert's body about two and one-half hours later.
After the collision, Rush left the scene of the accident, reports said, and went back to California. He later returned to La Paz County with attorney Ron Cordova and turned himself in. He was held on a $1 million bond, which was later reduced.
When a defendant pleads "no contest" the result is conviction on the charges and for sentencing purposes, the plea is the same as a guilty plea. However, unlike a guilty plea, it may not be used in a subsequent civil case as proof of guilt.
Burke and the attorneys determined Sept. 17 as Rush's sentencing date. The Herbert family will be in attendance, as well as their attorney, Michael Sutton.
