I got a subpoena today regarding the incident when the guy pulled a knife on me last week at work.  He is charged with 2 felonies, robbery and assault with a deadly weapon other than a firearm.

Here's some stats for JUST THE LAST 3 YEARS and JUST IN ORANGE COUNTY:

Violation date:

11/2004 - Plea bargained a misdemeanor charge of assault with a deadly weapon other than a firearm down to misdemeanor battery.

3/2005 - Convicted of misdemeanor vandalism

6/2005 - Convicted of misdemeanor assault and battery on a peace officer

9/2005 - Convicted of misdemeanor resisting a peace officer

4/2006 - Convicted of misdemeanor defrauding an innkeeper

8/2006 - Convicted of misdemeanor defrauding an innkeeper

9/2006 - Convicted of misdemeanor defrauding an innkeeper

10/2006 - Convicted of misdemeanor defrauding an innkeeper

10/2006 - Convicted of misdemeanor obstruct/intimidate/business/ customers

2/2007 - Convicted of misdemeanor obstruct/intimidate/business/ customers

3/2007 - Convicted of misdemeanor defrauding an innkeeper

3/2007 - Convicted of misdemeanor defrauding an innkeeper
(separate incident)

I left some things out too.  There's too many probation violations and jail sentences to write, but I think you get the picture. :eek

He has now graduated to felonies though. :fouet

Thanks.  :) At least there was no actual contact.  He just threatened to stab me as he thrust a knife forward. It definitely made be back away though.  :eek

Did anybody see the cops show, where the very big guy, must have been 250lbs, 6'8 was not working with the cops, and they hit him with that tazzer gun, Man that dude was crying like a baby, stop stop that hurts.LOL

I don't know how it works over in CA, but Resisting Arrest and Assault on a Peace Officer (with no injuries) are fairly low level felonies. They can be reduced to misdemeanor for plea reasons. Although I don't agree with it, it's common for them to be reduced.

What would be misdmeanor assault, say just shoving someone, for a normal person, turns into Felony Aggravated Assault if the assaulted is a Peace Officer.

But some prosecutors feel that it's in our job description to be assaulted by dirtbags. :stupid  :angry

And for Shueman's question, the justice system doesn't protect the victims. It protects the criminals.

I went to http://occourts.org and navigated to criminal cases.  You can search by name or case number.  Once you pull up the case, you'll see links to every other case for that person.  It only goes back around 3 years though.  I tried it on myself and saw a traffic ticket that was dismissed by going to traffic school. :rotflmao

Well it's finally over. :good He was convicted of assault with a deadly weapon other than a firearrm and was sentenced to 150 days in jail and 3 years probation.  He changed his plea on that count to "guilty" and the robbery charge was dismissed.  I don't know how much of the 150 days he will serve, but he's already been in jail since this happened over 2 months ago. :)

seems like a minor amount of time considring he threatened a life, no matter how threatening or not the encounter may have been.

I agree on that not seeming like a very long sentence, but at least he is a convicted felon now.  All the other cases I mentioned were misdemeaners.  Also, I was not looking forward to taking the witness stand. :eek At least I don't have to now. :jumpie
