I think I might just stay here in ohio, something is wrong with your goverment out there, better start saving your nickels and dimes people, the price of food is going to sky rocket.

CARB adopts statewide port rule to limit diesel emissions by 2009 The California Air Resources Board unanimously approved sweeping new rules Friday to block older trucks from ports by late 2009 and require all trucks to meet 2007 emission standards by late 2013.

CARB spent four hours hashing over the port drayage truck rule, including hearing comments from 36 members of the public and debate between board members about the rule’s implications.

The rule means that by Dec. 31, 2009, all drayage trucks must be retrofitted to include 1994 model year engines or newer, and 1994 through 2003 engines must have a level 3 VDECS. By Dec. 31, 2013, all drayage trucks must meet 2007 emission standards.

Other portions of the new rule aren’t yet clear how they’ll be enforced. CARB officials hinted at trying to work with port administrators to influence how the regulation will be enforced locally.

Several statements from CARB officials, however, shed light on the agency’s perspective.

Mike Miguel, who heads CARB’s port truck rule team, told the board that 80 percent of goods hauled to and from the ports of Los Angeles and Long Beach are from fleets that rarely leave the Los Angeles area. The agency is aware that its regulation is likely to change the structure of port trucking.

“Post regulation, non-frequent visiting fleets are expected to switch to other trucking sectors,” Miguel said. “We expect that most non-frequent (visiting) truck owners will choose not to install the equipment needed to comply with this rule.”

Later in the meeting, CARB Chairman Mary Nichols asked that board members not ask questions regarding the port labor issue. The Teamsters are attempting to persuade the ports of Long Beach and Los Angeles to require that all drivers entering the port be company employees, and that only trucks from companies licensed as concessionaires be allowed into the port.

“This is an incredibly complicated industry, as we’re beginning to tell,” Nichols said.
“There is a movement going on to try to organize (truck drivers in ports). All of which is healthy, and good, and which we want to be supportive of.”

OOIDA representatives were among several groups who criticized CARB’s definition of port drayage truck – defined as any 33,000 pound diesel truck that ever visits a port.

Matt Schrap of the California Trucking Association, called CARB’s port rule “an eyesore” and said it should be redirected to staff before being considered for approval by the board.

Board Member Sandra Berg suggested CARB consider turning away trucks at the port gate as a way to enforce the new emission rule.

Michael Terris, a senior attorney for CARB, however, clarified to board members that the agency may open itself up to legal challenges related to the Interstate Commerce Clause of the U.S. Constitution if it specifically bars trucks from entering ports based on a specific state law.

Instead, the agency will try to work with ports such as the Port of Long Beach and the Port of Los Angeles, CARB officials said.

Joe Rajkovacz, OOIDA’s regulatory affairs specialist, told board members that long-haul truckers want to maintain access to ports.

“Our folks are not against clean air; they want to be compliant, do the right thing,” Rajkovacz said. “But we also want it to be done sensibly.”

“It’s an onerous burden on interstate commerce, and in terms of being able to accomplish what they want, it’s not a true way to verify enforcement.”

Earlier drafts of CARB’s port rule included a drayage truck registry and a sticker requirement for trucks from any state that enter California. OOIDA voiced its concerns in an 11-page comment paper this week. Early Friday, OOIDA officials learned that CARB had modified several pieces of the regulation after receiving the comments but details on the modifications were not available.

Rajkovacz said OOIDA plans to continue working with CARB to minimize problems for long-haul truckers who periodically stop at ports. It appears out-of-state drivers would still have to register if they ever plan to make drops at 14 California ports, Rajkovacz said.

“It’s all still problematic,” Rajkovacz said.

Nichols and several CARB officials hinted that the easiest part of regulating port trucks remained in writing the rule.

“The difficult, task is ahead of us, in actually making it work,” she said.

Call it a coincidense, but isn't it funny that china is investing *billions* of $$$$$$ in mexico's pacific ports??.........and with the "NAFTA super hiway" plans, along with mexican carriers allowed in the US now,..........all this is really starting to make sense!!!

Of course it does............................

Ban older trucks from the ports (you know they will be sold to mexican carriers)

Deliver the containers to mexican ports (I doubt they will have emissions compliant tugs like Ca. ports will have to have)

Then deliver the cargo to the U.S. via mexican carriers with the trucks we can no longer drive. (thank you NAFTA and CARB)

How many back rooms do you think all these govts. sat in figuring this master plan out?

The "One world economy" is on it's way. and it looks like we are going to be a bit player

California idling limit begins Jan. 1; misdemeanors possible Truckers who cross the California state line after Jan. 1, 2008, have a new reason to dread doing so: On New Year’s Day the state begins enforcing a new anti-idling measure that doesn’t exempt sleeper time.

For the past two years, California has enforced a five-minute limit on truck idling, but allowed drivers to idle during sleeper-berth time.

That changes with the New Year, and the California Air Resources Board has boosted fines for violating the idling rule from $100 to $300. CARB also increased the number of enforcement officers.

A CARB official confirmed to Land Line on Friday, Dec. 28, that egregious idling could result in fines of $1,000 per day and even criminal charges, although such prosecution would be rare.

“The 1,000 per day fine is something ARB can legally levy for the most flagrant violations and while its use is unlikely, it is not impossible,” said Karen Caesar, a CARB spokeswoman. “As for the potential to file criminal charges, that too, would be highly unlikely. However, the (California Health and Safety Code) gives us the option to charge this violation as a misdemeanor if the circumstances dictate.”

The new rule does include exemptions, although they’re mostly for temperature-dependent loads or for brief truck inspections, maintenance or windshield purposes.

Trucks may idle while queuing, while hauling temperature-dependent loads, to avoid a health emergency, or to defrost the truck’s windshield. Other exemptions include idling to regenerate an engine exhaust system’s diesel particulate filter “due to immediate adverse weather conditions affecting the safe operation of the vehicle or due to mechanical difficulties over which the driver has no control.”

More information is available at the California Air Resources Board’s Web site at www.arb.ca.gov.

Also on Jan. 1, 2008, CARB will begin enforcing a ban on diesel-powered APUs for trucks with 2007 or later model year engines. Model years 2007 and later will, however, be allowed to use diesel-powered APUs that have been retrofitted with a CARB-approved DPF filter. 2007 model year engines actually emit less diesel particulate than APUs.

OOIDA Member Richard Rollins recently told Land Line that the new idling law won’t bother him.

“I will never have to worry about a ticket there,” Rollins wrote in an e-mail. “I also intend to help them in their smog and pollution problems.

“My truck will no longer go into California.

It might be why this one company I called they are setting up a drop point in kingman,az and then running only so many trucks into cali and back, drop and hook and then the way they go across country.

I'll tell you what's wrong with this place . . . the inmates are running the asylum!  We passed 2 bond measures for schools last June.  Now the schools need to make 10% cuts across the board?  What happened to the $$$$$  I'm about to pull my friggen hair out!  Guess what?  There is ANOTHER bond measure for schools on this ballot next week!  I admit, I voted for the other two in hopes they would end year-round school.  No more.  This place is f_ed.  I cannot wait to leave.  Let the Mexicans and welfare losers have it.

Well, the reason we moved outta Cali was because it was getting more and more restrictive and harder to make a living.  I've been back to California 2 times in the past 2 1/2 years since we moved and both times I couldn't wait to get outta there and back home here.  I remember stepping out of the front door of the motel room the last time I was there and the air smelt awful :puke  :puke
And the politicians there that practice the "Do as I say not as I do" principle are outrageous!  I can't believe there are so many naive people in California that keep electing them to office!  As far as I'm concerned, all of the politicians in California can kiss my  :ass  :ass  :ass

On the other hand, there are folks from California flooding this area of Eastern WA/Northern ID.  Everywhere I go I meet folks that recently moved here from California.  As long as they leave their California attitudes at the door along with their politics, we'll be cool :D  :D  :guns  :guns  :guns  :guns  :D  :D

I heard a add on the radio the other day, not sure what it was about, but I caught the end when they said " this offer is good only to new ohio residents only, while supply's last" LOL Better hurry and move on in.
