City to mull accident suit for $250K

The Lake Havasu City Council could decide Tuesday to authorize a lawsuit settlement agreement with a local man injured in a rollover and his family.
The recommendation for an agreement of $250,000 comes after a jury earlier rejected awarding Ryan Meehan damages, and a trail judge later dismissed an appeal and motion for a new trial but left open the issue of damages.
Meehan and his family filed a civil lawsuit against the city for injuries Meehan suffered during a 2002 rollover accident.
Meehan suffered serious injury after being ejected from the vehicle when he failed to yield to a police car and lost control while eluding police.
Meehan and his parents sued the city and the officer for negligence on the part of the police officer in pursuit of Meehan’s vehicle, negligence on the part of the city for failing to properly train and supervise the officer and loss of financial capital for Meehan’s parents.
In September 2008, a jury ruled regarding liability Meehan was 82 percent responsible for the accident and Lake Havasu City and the officer were 18 percent at fault.
Although Meehan was not awarded damages, his parents were awarded $12,150 for their consortium claims after deductions for comparative fault.
To avoid further litigation and expenses, City Attorney Paul Lenkowsky is recommending the council vote to approve the settlement with the Meehan family.
Lenkowsky said the city has already met its insurance policy deductible, and the settlement amount would be covered entirely by the city’s insurance carrier, at no additional cost to the city.
“The settlement is intended to wrap up any pending litigation,†Lenkowsky said.
The settlement does not, however, admit any liability on the part of the city or the police officer in question, Lenkowsky said.
The City Council meeting will be held Tuesday at 6 p.m. inside the council chambers at the Police Facility. It is open to the public.

Total BS!!! The dude should feel good that the officer didn't shoot his stupid A$$ either with a pistal or the tazzer. I like the idea of sending them a bill for the gas and so on. I would also like to know if he paid the tickets that he should have received for this little adventure.
